A Massachusetts builder recently received a $1 million settlement for the personal injuries that he sustained while working. The settlement came after the worker tripped and fell through an opening in the floor of the home that he was renovating. The man shattered his dominant arm, requiring multiple surgeries, including the shortening of his ulna bone.
The man was working as a subcontractor on a residential home remodeling project when the construction site injury occurred. In his lawsuit, the construction worker claimed that the building code required that the opening in the floor be covered to prevent exactly this type of personal injury accident.
The defendants argued that the worker was responsible for his own personal injuries and that the hole was covered when last inspected by the construction supervisor.
Before trial, the case settled for the policy limits, and an additional sum of money from the uninsured property owners, totaling $1 million.
