Workers at construction sites face many hazards. They rely on their employers to protect them from these dangers. However, often times, employers are negligent or reckless in the way they manage their construction sites, which can result in severe injuries for the workers. On April 15, 2015, Jared Overfield, an employee of Marggiora & Ghilotti, was working on a road construction project in Petaluma, California. The project involved replacing an old water pipe along the edge of the road. Overfield was working with a forklift operator, who was moving an 8,000 pound steel pipe down a sloping dirt road. While the forklift was traveling down the sloping road, Overfield was standing at the bottom of the hill. All of a sudden, the pipe came loose and started to roll down the hill. Overfield was crushed to death.
Now, the California Division of Occupational Safety and Health is fining the construction firm $38,250 for their reckless actions. The Division claims that the construction company failed to follow proper work safety regulations when preparing the construction site and the equipment. According to The Press Democrat, the Division found that the pipe was not properly secured to the forklift. Furthermore, there was nothing on the sloping hill that could have prevented it from rolling down toward the workers at the bottom. Practices such as these underscore the construction company’s recklessness.
The Division is run by the California Department of Industrial Relations, which released a statement saying this death could have been avoided had Marggiora & Ghilotti followed proper safety protocol. The Department went on to say that employers are responsible for protecting the safety of their employees.
